Jamison Gilmore represents clients in complex commercial disputes from pre-litigation through trial and arbitration. His practice spans trade secret misappropriation, breach of contract, copyright infringement, and unfair business practices matters across a variety of industries, including media and entertainment, technology, healthcare, energy, and construction.

 

Jamison handles all aspects of disputes, including pleadings, discovery, dispositive motions, depositions, and trial and arbitration preparation. He has prevailed at each trial and arbitration he has handled, securing permanent injunctions, judgments, and significant attorneys’ fees awards.

 

Jamison maintains a robust dispositive motion practice and has successfully prepared and defended against motions to dismiss, demurrers, motions to strike, anti-SLAPP motions, and motions for summary judgment. Before entering private practice, he externed for U.S. Magistrate Judge Michael Wilner (ret.) and clerked for Los Angeles Superior Court Judges Christopher Lui, Theresa Traber, and Daniel Crowley, where he prepared over 3,000 tentative orders—none of which were reversed on appeal. Prior to joining Weinberg Gonser LLP, Jamison practiced at King & Spalding LLP and Blank Rome LLP.

Representative Matters
  • Represented a United States franchisor in a trade secret misappropriation, trademark infringement, and business tort action.
  • Represented a manufacturer of car detailing products in a trade-secret misappropriation action against a former director.
  • Obtained a dismissal of copyright infringement claims against a publicly-traded media client.
  • Secured an order stating the court lacked personal jurisdiction for one of the largest oil manufacturers in the world in a wrongful death, negligent hiring, and public nuisance lawsuit involving an accident that occurred in a state outside of where the relevant petroleum-based product was manufactured.
  • Obtained an order granting a client’s anti-SLAPP motion striking portions of the plaintiff’s complaint based on protected speech from the client’s employees and counsel. Also obtained a related award of attorneys’ fees for successfully moving to strike portions of the complaint.
  • Represented a pharmaceutical company in securing a permanent injunction under five states’ unfair business practices statutes after a four-day Zoom bench trial against a competitor for selling a drug that was essentially a copy of the client’s drug.
  • Secured summary judgment for a major drug manufacturer against allegations that it failed to warn of harm caused by its second-generation anti-psychotic medication.
  • Succeeded on merits in trade secret arbitration and subsequent award of six-figures in attorneys’ fees.
  • Represented one of the nation’s largest health systems in an action seeking indemnification from an interventional cardiologist whose submission of false claims to the U.S. government resulted in millions of dollars of liability under False Claims Act, Stark Law, and the Anti-Kickback Statute.
  • Secured complete dismissal of California Health & Safety Code violations on behalf of one of the nation’s largest health systems.
  • Secured complete dismissal of sexual harassment claims on eve of arbitration.
  • Represented an international manufacturer of hair care products in a false advertisement action, successfully securing transfer of the action to a favorable jurisdiction.
  • Represented businesses alleged to have violated California’s Proposition 65 statute.
